On 1st October 2023, The Building Safety Act 2022 (‘BSA’) brought in the biggest changes to Building Regulations for a generation. Whilst its primary focus was a reaction to the Grenfell tragedy, it includes changes that will apply across all construction projects.
The new legislation particularly affects High-Risk Buildings (‘HRBs’) – buildings 18m and/or 7 storeys high, with at least two residential dwellings - and brings a raft of procedural, competency, paperwork and programme changes, with the new Building Safety Regulator (‘BSR’) being the building control authority for all such buildings. New Mandatory codes and standards are now required for all Building Regulation Approvers and Inspectors.
However, the changes are not just about HRBs and affect all projects that require Building Regulations. The implementation is largely copied from CDM 2015; providing further duties for Clients, the need to separately appoint a Principal Designer (BSA) and Principal Contractor (BSA) who subsequently have further duties now to ensure compliance with Building Regulations during design and construction phases. Oh, and there’s a large focus on competence!
