Workshop Director: barrister, mediator and arbitrator, Andrew Parsons FCIArb

The aim of this Workshop is to bring together professionals from as many different disciplines as possible for an intensive full day of training and inter-active discussion about dispute resolution processes currently available in the UK, focusing in particular on mediation.

This Workshop affords a good opportunity to meet and discuss practical problems arising in mediation and other dispute resolution processes. Throughout, the Workshop will be inter-active.

Participants will discuss practical problems and be asked to express their opinions. Dissenting opinions are encouraged.

Participants are invited to submit real problems and issues encountered from their own experience for discussion.

Workshop Programme

• A very brief introduction to what mediation is and what it involves.
• A comparative analysis of dispute resolution processes currently available in the UK – Do you know what processes are currently available?
• Why mediation can no longer accurately be described as "alternative".
• Key things to bear in mind when advising clients about dispute resolution processes such as mediation.
• Understanding when mediation may not be appropriate – Reasons not to mediate Part 7.
• Understanding the best time to mediate – How to avoid premature or tardy mediation.
• Are mediation clauses binding?
• Practical case examples for discussion.

Course Director - Andrew Parsons FCIArb

Andrew Parsons is an experienced barrister, mediator and arbitrator. He was called to the Bar in 1985 and founded the Portsmouth Barristers' Chambers in 1990.

Prior to practising at the Bar he worked as a money and corporate finance broker in the City of London. He has a purely civil practice, specialising in business, commercial, company, construction, financial, partnership, personal injury, professional negligence and property work.

Mediation credentials

Andrew has for many years been committed to the use of ADR processes such as mediation as a more sensible and civilised way to resolve disputes. 17 years ago, in 1998, he was one of the first English barristers to become an accredited commercial mediator. Since then he has conducted over 300 mediations and acted as a specialist mediation advocate in thousands of cases. He sits on the ADR Committee of the Bar Council and is the current Chairman of the Southern Branch of the Chartered Institute of Arbitrators. He is a member of The City Disputes Panel.

In real life, cases do not fit into neat categories. Nor do the means of resolving them. A key advantage to instructing Andrew is that he is versatile, having experience and expertise in overlapping categories of work. As a mediator, he draws on his knowledge and experience gained as a broker, barrister and arbitrator to good effect, helping parties to a dispute find their own creative, cost-effective, solutions.
