A Series of 4 evening sessions leading to an optional assessment to obtain ACIArb qualification

The Adjudication Workshops will provide opportunities to receive comprehensive instruction and to participate in group discussions led by acknowledged experts and practitioners of adjudication under the Housing Grants Construction & Regeneration Act 1996 (as amended) and related contractual provisions.

The Workshops will be of interest to building and construction professionals, solicitors, party representatives and anyone interested in adjudication whether experienced or a student of the subject. Attendees will be separated into groups appropriate to their level of training and experience from beginners through to adjudication practitioners.

The course material will look at the adjudication process from not only the adjudicator’s position but also the parties’ and their advisors’. This will include the procedural aspects such as the presentation of evidence of facts at employee level, together with matters to be taken into account by legal advisers and those acting as expert witnesses.

There will be extensive reference to the numerous decisions in the Courts relating to adjudication over the past few years particularly concerning natural justice and jurisdictional matters. The sessions will consider the ‘old’ regime for contracts entered into pre October 2011 as well as the later developments arising from the payment regime introduced by the Local Democracy Economic Development and Construction Act 2009.

Optional Assessment to obtain ACIArb qualification

The CIArb has 3 levels of qualification – Associate (ACIArb), Member (MCIArb) and Fellow (FCIArb). The normal route to joining the Institute is via the CIArb’s Introductory Courses which take place in London and cost £480. Attendees of these workshops can sit an optional written assessment (for a separate fee of £60 + VAT), successful completion of which will entitle you to apply for Associate Membership. 23 of last year’s 24 candidates passed!

NB: The assessment is optional. All delegates will cover the same content regardless of whether they want to be assessed or not.

Robert Sliwinski: BSc, LLB (Hons), DipIntArb, FRICS, FCIArb, Barrister, Attorney (New York)

Robert is a Chartered QS, practicing Barrister and is amongst the leading adjudicators working in the UK today. He was called to the Bar in 1990 and has practised as a barrister (and as a solicitor between 2005 and 2011) specialising in all aspects of the construction industry. He is also an accredited Mediator and Chartered Arbitrator on several UK and overseas panels.

Matthew Bastone: DipArb, FRICS, FCIArb

Matt is a chartered QS and arbitrator and is a leading adjudicator on the panels of RICS, CIArb, RIBA, AICA and CEDR. He comes from a background of national contracting with over 30 years’ experience of the UK construction industry and is a former director of Alfred McAlpine South and Kier Build Ltd.

Mark Thomas: DipAdj, BSc, MSc, LLM, FRICS, FCIArb, MAE

Mark is a chartered QS, project manager, expert witness and construction adjudicator. He has specialised for many years in the training expert witnesses and construction practitioners regarding the adjudication and payment provisions of the ‘Construction Acts’. He is the current Chairman of the CIArb Thames Valley branch.

Roger Smith: DipArb, FRICS, FCIArb

Roger is a chartered QS and partner of a central London practice specialising in dispute resolution, whose primary business is preparing parties for, and representing them in, adjudication. He has over 30 years’ experience in contracting and consultancy organisations. He is the current Vice Chairman of the CIArb Thames Valley branch.
