'A Mock Adjudication'

A joint meeting has been arranged between the Thames Valley Branches of the Chartered Institute of Arbitrators and the Society of Construction Law.

Following the amendments to the Housing Grants, Construction and Regeneration Act 1996 by the Local Democracy, Economic Development and Construction Act 2009, the procedures for issuing Payment Notices have changed as have the consequences of failing to issue such a notice. Additionally, Withholding Notices have been replaced with Pay Less Notices. Disputes arising as a result of these changes are now increasingly being referred to adjudication with decisions being given that sometimes surprise the parties!

The CIArb branch committee is joined by leading law firm, Veale Wasbrough Vizards, to present ‘A Mock Adjudication’. The dispute referred to adjudication centres on the now thorny issue of applications for payment and payment notices issued under construction contracts. The presentation will comprise various scenes starting with the disgruntled referring party seeking advice on how to resolve its dispute, through to the adjudicator giving his Decision following the written submissions from both parties and an adjudicator’s meeting. The presentation will give a practical insight as to how the adjudication process is conducted as well examining the issue of payment notices and the pitfalls that can occur when agreed payment cycles and timetables are not adhered to by a party.

The presentation will encourage audience participation by interspersing the scenes with electronic voting on what the audience anticipates will be the outcome of particular scenarios and will be followed by a question and answer session at the end of the presentation.
