Defending Disciplinary Proceedings in RICS Prosecutions

Introduction

Surveyors are routinely prosecuted by the RICS for a variety of alleged breaches of its professional rules.

This seminar is designed to help you de-mystify the process of dealing with a RICS disciplinary investigation whether as surveyor yourself or a legal advisor. Due process and fairness and how this applies in practice will be explored together with serious cases and lessons learned.

What You Will Learn

The seminar will cover the following:

  • Could this happen to you/your client?
  • How could it happen?
  • How to deal with the RICS investigators
  • The importance of legal representation
  • The procedure of the tribunal
  • How to handle the tribunal
  • Recent cases
  • Human Rights implications

Speaker: Marc Beaumont FCIArb, is an English Barrister called to the Bar at Gray´s Inn in 1985. He is based in Windsor, London and New York (see www.windsorchambers.com).  Marc is an experienced litigator and advocate in commercial, property and arbitration work, but he  has been active throughout his career in the defence of other lawyers (especially Barristers) in professional disciplinary proceedings. He has been described on the BBC Radio 4 Today Programme as, ‘the Barrister’s Barrister,’ a public accolade deriving from his successful and fearless defence of Barristers in disciplinary proceedings. Marc is also well known for his tenacious advocacy on behalf of Chartered Surveyors in recent years, in another field dominated by a powerful regulator.
