Andrew will examine the current relationship between litigation and mediation in dispute resolution arenas in the UK. He will explore what he describes of the as the rapidly changing face of mediation over the last few years, the current trends and the likely role of mediation in the future of the dispute resolution process in the UK. Andrew will consider:

  • Whether mediation remains a true alternative dispute resolution process?
  • The attitude of the English Judiciary to the mediation over the last 15 years.
  • The role of lawyers in the mediation process and the advancement or restriction of that process.
  • The advance of Early Stage Mediation, what is it exactly, when can and should it be used and how early in the process can parties engage in mediation?
  • The Active v Passive mediation. The new breed of mediators and mediation style in facilitative mediation and the impact this is having on the mediation process.
  • The future of mediation and top tips from the coal face.

Andrew Miller QC has over 25 years of experience dealing with and resolving commercial disputes both domestically and internationally. He practises as a Mediator and Arbitrator in a wide range of commercial sectors construction, energy, property damage, insurance and reinsurance, professional negligence and general commercial disputes. A CEDR Accredited Mediator, he has experience of more than 150 mediations on sums ranging between £10,000 & £30 million. Andrew is also a qualified and accredited arbitrator involved in domestic and international disputes valued at up to half a billion US$.
